Court of Claims - RG 302 | Illinois State Archives

Name: Court of Claims - RG 302
Variant Name: Commission of Claims

Historical Note: n 1877 the General Assembly created the Commission of Claims to hear and determine all unadjusted claims against the State of Illinois (L. 1877, p. 64). The commission was composed of one judge from the Supreme Court and two circuit court judges, all appointed by the Chief Justice of the Supreme Court. In 1889 the law was amended to allow the Governor to appoint all commission members (L. 1889, p. 89). The Court of Claims succeeded to the commission's duties in 1903 and the Auditor of Public Accounts was named ex officio clerk for the court (L. 1903, p. 140). In 1917 the court's authority was increased and the Secretary of State assumed the Auditor's duties as clerk for the court (L. 1917, p. 325). The court continues to hear and determine all claims made against the state except those arising from the Workmen's Compensation Act or the Workmen's Occupational Diseases Act which fall under the jurisdiction of the Industrial Commission.
